Shareholders' disputes

Shareholder disputes can arise in both public and private companies and the law relating to each type of company have certain common attributes and some that apply only to public companies.  

During my career I have acted for shareholders in both public and  private companies in disputes with the company in question and or other shareholders in the company.  


Cases

Reliance Group v Shaeffer & Others  20 December 1999 Elias CJ CL10/96.
An  11 week High Court trial concerning alleged breach of sale and purchase of shares by the defendants to the Plaintiffs

Bushetts Transport v Lowes 25 February 2011 CIV 2010 485 -7120

This was an action bought against the defendants by the plaintiff alleging breach of a contractual restraint  in a shareholders' agreement and misuse of confidential information. The proceedings commenced with a successful injunction application before Miller J.
